Reflexões sobre a situação jurídica e social dos refugiados no Brasil

Abstract

A questão imigratória agravou-se ao decorrer dos anos e nos dias atuais é considerada pela Organização das Nações Unidas (ONU) a mais grave crise humanitária, ultrapassando até as guerras mundiais. Este fato ocorre pelas crises sociais, políticas e econômicas, entretanto os locais que servem de asilo para os refugiados também são afetados diretamente. Ainda que os mesmos cheguem nos países em busca de uma vida agradável, muitos são condicionados a situações cotidianas impertinentes se não forem legalmente reconhecidos. Com o avanço excessivo de solicitações de refúgio, as políticas brasileiras foram alteradas tornando-se rigorosas, o que dificulta a vinda e permanência dessas pessoas no território nacional. Na presente pesquisa, realizada por meio de pesquisa exploratória de cunho bibliográfico e na legislação vigente, pretende-se discutir a situação dos refugiados no Brasil quanto às suas consequências jurídicas e sociais, identificando a legislação aplicável ao seu reconhecimento nessa condição, bem como as garantias legais para aqueles que assim o forem reconhecidos e discutir os impactos da migração no país e na vida dos cidadãos brasileiros.

The immigration issue worsened over the years and today the UN condemns the most serious humanitarian crisis, surpassing even world wars. This fact has arisen by social, political and economic crises, so the places that are for the refuges are also affected directly. Although they arrive in countries in search of a pleasant life, many are conditioned to impertinent everyday situations that are not legally recognized. With the excess of decision-making, the Brazilian policies were changed, becoming rigorous the verification of the duration and the permanence of the people in the national territory. In the present research, conducted through an exploratory bibliographical research and current legislation, it is intended to discuss the situation of refugees in Brazil regarding their legal and social consequences, identifying the legislation applicable to their recognition in this condition, as well as the guarantees legal for those who are recognized and discuss the impacts of migration in the country and in the lives of Brazilian citizens.
