A obrigatoriedade do voto no Estado democrático de direito

Abstract

Este artigo tem como objetivo analisar a improficuidade da obrigatoriedade do voto, já que não previsto em cláusula pétrea, pode ser posto em discussão e até habituado ao modo facultativo, por meio de emendas constitucionais. Iniciando com uma contextualização histórica quanto a formação legislativa do voto, seguindo do Estado Democrático sua funcionalidade e exercício da democracia contextualizado a nacionalidade, tendo como instituição as classificações do sistema eleitoral processual, em conjunto com os direitos políticos e por finalidade identificar os problemas quanto ao voto obrigatório, citados quanto a falta de educação política e interesse da conjuntura social.

This article aims to analyze the ineffectiveness of mandatory voting, since it is not provided for in a stony clause, it can be discussed and even accustomed to the optional mode, through constitutional amendments. Starting with a historical contextualization regarding the legislative formation of the vote, following the Democratic State its functionality and the exercise of democracy contextualized to nationality, having as an institution the classifications of the procedural electoral system, together with political rights and for the purpose of identifying the problems regarding the mandatory vote, cited as the lack of political education and interest of the social conjuncture.
