Primeiramente,é necessário que se faça a distinção entre a prisão penal da prisão civil. A primeira tem como objetivo principal a punição do indivíduo, retirando o mesmo do convívio da sociedade em determinados casos, e a segunda não tem natureza punitiva e,sim, coercitiva; visa o cumprimento de uma obrigação, isto é, refere-se ao ilícito de natureza civil. A presente tem como objetivo examinar a obrigação do alimentante e a prisão civil,caso necessário, ou seja, existindo o inadimplemento da obrigação alimentar, através da pesquisa doutrinária e da legislação pertinente ao tema. Os alimentos existem para satisfação das necessidades de quem não pode provê-las. Compreende alimentação, vestuário, habitação, tratamento médico, transporte, diversões, e, se o alimentado for menor de idade, ainda valores para sua instrução e educação, incluindo despesas oriundas com sepultamento. Podendo ser classificados quanto à finalidade, à natureza, à causa jurídica e ao momento da reclamação. A prisão civil é realizada no âmbito do Direito Privado, originando-se em face de dívida não paga, ou seja, de um dever ou obrigação descumprida e baseada em norma jurídica de natureza civil, tendo por objetivo a prisão civil do alimentante inadimplente, sendo inadimplente do dever alimentício. Assim, a prisão civil é meio executivo da finalidade econômica.Prende se o devedor, não na intenção de puni-lo, como se fosse criminoso, mas sim para forçá-lo a pagar, partindo do pressuposto que tenha meios de saldar a dívida e queira evitar a perda da sua liberdade, ou recuperá-la.
