Corrupção passiva da arbitragem no futebol brasileiro.

Abstract

trata-se de uma monografia cujo tema é corrupção da arbitragem no futebol. Baseia-se, especialmente, nas disposições legais da corrupção passiva cometida em âmbito futebolístico, suas punições e demais implicações jurídicas. A relevância do tema, analisado em nossas pesquisas, é demonstrar que a corrupção não se limita somente a política e sociedade, ela também atinge a principal fonte de entretenimento do brasileiro, que é o futebol, chegando até então a diversos escândalos, tendo como principais a “Máfia do Apito” que ocorreu no Campeonato Brasileiro de 2005 e recentemente a “Interferência Externa” no Campeonato Paulista em 2018. Por conta desses fatos e um deles ocorrido recentemente, resolvemos, então, dar ênfase a essa temática. Inicialmente, aborda-se sobre os conceitos de arbitragem, corrupção e a união dos dois conceitos que desemboca no nosso tema. Além de expor a evolução histórica do delito e otimização das Leis. Foi tratado também os deveres e direitos de órgãos organizadores de eventos esportivos e uma breve comparação entre casos de corrupção no futebol de Brasil e Portugal. A finalidade foi relatar acerca da aplicabilidade do Estatuto do Torcedor afim de cessar ou amenizar os casos de desordem no futebol. Executando esse tipo de pesquisa objetivando decisões penais no futebol. Por fim, concluem-se com auxílio do questionário piloto diversas hipóteses levantadas ao longo do trabalho e principalmente no desenvolvimento.

There is based, specially, the practice of the passive corruption committed by the arbitration and his punishments, legislation on the legal extent. The relevance of the subject, lifted in our inquiries, is to demonstrate that the politics and society does not limit the public corruption only, it also reaches the principal fountain of Brazilian entertainment, which is the football, reaching up to that time several scandals took place in Brazil, we can quote those main ones: the “Mafia of the Whistles” that took place in the Brazilian Championship of 2005 and recently the “Extern Interference” in the Championship of Sao Paulo in 2018. On account of these facts and one of them happened recently, we resolve, then, to give emphasis to this theme. Initially, it is boarded on the concepts of arbitration, corruption and the union of two concepts that gives itself our subject. Besides exposing historical evolution of this crime and optimization of the Laws. It was treated also the duties and rights of organizing entites of sporting events and a short comparison between cases of corruption in the football of Brazil and Portugal. The main goal was the applicability of the Statute of the Supporters stop or amend the cases of corruption in the football. Finally, one concludes with help of the questionnaire several hypotheses lifted along the work and principally in the development.
